Parentage Cases

A parentage case is a family law case which is filed on behalf of a minor child or children for the purpose of determining parentage, i.e. who are the child’s parents. You’ll often hear this type of case referred to as a paternity case. While this term is often used and still widely accepted, the term “parentage” more accurately reflects modern interpretations of the law by our higher courts. The definition of “family” is ever-evolving due to changes in our laws and in our society such as legalization of same sex marriage or the increased popularity of artificial insemination and surrogacy arrangements associated with children born to same sex couples. Overall, there has been a big spike in non-traditional family units and with that the door opens for a number of potential parents who had otherwise been unable to obtain parental rights. A parentage or paternity case works very similarly to a Divorce or Dissolution action without the need to “divorce” the parents as they are already unmarried. Custody and parenting time issues are treated the same. There will still be a parenting plan as in a divorce and child support is calculated in the same manner, using the same Child Support Worksheet (KS) or Form14 (MO). At the end of the case instead of getting a Decree of Divorce or Dissolution, you’ll get a Journal Entry or Decree of Parentage/Paternity.
